Usher Raymond?and Tameka Foster Raymond‘s?oldest son, Usher Raymond V aka ‘Cinco’ (pictured above right with brother Naviyd) is reportedly recovering in an Atlanta area hospital after nearly drowning at his father’s home earlier this week.

EOnline reported the following yesterday:

A reported friend of Foster’s took to her local Atlanta blog recently to give an update on the 5-year-old’s condition.

My site has often been referenced as a source by many huge outlets,?but never have I been referred to as a “friend” of xyz’s…

And while Tameka and I are not mortal enemies but I wouldn’t consider us “friends”.

My long time readers are aware of my history with Tameka and how my opinion of both her and Usher changed when I attended their first round of child custody hearings.

There’s a scandal brewing between these two and with Usher’s image on the line, you can best bet that ‘Olivia Pope’ will be the case ‘spinning’ the news in his favor. It’s expected.

But a “friend” though? 😯 ?Yeah… anyway.

Legal documents were filed Tuesday (August 6, 2013) at the Fulton County Superior Court, on behalf of Tameka Raymond, requesting an emergency hearing on their child custody issues.

Tameka had been planning an appeal of the judges original decision in the case but things were apparently taking to long to proceed. ? From what I understand, her attorneys reopened the case last June, requesting to modify the existing order.

When Lil Cinco’s accident occurred Monday, Tameka’s attorneys filed the motion for the emergency hearing because the children were scheduled to be released back into Usher’s care and from the looks of things, Tameka isn’t too comfortable with the children being cared for by Rena Oden, Usher’s aunt.

A judge has agreed to the emergency hearing and Tameka seeks to temporarily change the fact that Usher has primary custody.

The grieving mom has been by her Cinco’s side ever since the accident, so it’s sad to see how she’s been vilified in the media for taking action for the safety of her kids. Especially considering the fact that its only been approximately a year ago since Tameka buried her 11 year old son Kile, who was killed in an accident while he was visiting his father.

In a sworn affidavit attached to the court papers, Tameka says Usher ?leaves the children with caregivers when he travels around the world for work rather than parenting them himself.?

The affidavit said Tameka is ?more capable of caring for the children,? and ?the children have said they?d rather be with her than with caregivers.?

Other issues addressed in the affidavit are as follows:

TR accuses UR of planning to send uV to a ?school an hour away
TR accuses UR of not providing TR with current number
TR says UR ?will have to shoot a movie in Panama and has commitments in Los Angeles and New York and is hardly ever home to provide care for the children.

In my opinion, this isn’t about money… it’s not about a fight between exes… it’s all about the children’s safety.

The emergency court hearing is scheduled for tomorrow, Friday August 9, 2013.
