    Chuntera Napier (above left) and her 10 year old son, Gaquan, of Cobb County, show off their new ink to news reports yesterday.

    Napier was arrested earlier this week after someone at her son’s school reported his new tattoo.  She bonded out Wednesday after being charged with misdemeanor child cruelty for allowing her 10-year-old son to get the tattoo.

    Yes.  She actually granted permission for her son to get his first tatt inked permanently on his arm at the age of TEN.

    Chuntera said she only did it because her son wanted to honor his older brother who died in a drunk driving incident, and she had no idea it was illegal for the youngster to get tatted up…

    Details…

    “It made me feel good to know that he wanted his brother on him,” Napier said.

     Napier’s other son, Malik, was hit and killed by a teenaged drunk driver two years ago at the age of 12 and she says her family is still grieving his death.

    She also has her own tattoos in Malik’s honor.

    “My son came to me and said, ‘Mom, I want to get a tattoo with Malik on it, rest in peace.’

    What do I say to a child who wants to remember his brother?” Napier said. “It’s not like he was asking me, ‘Can I get Sponge Bob? Like people getting all kinds of things on them.

    He asked me something that’s in remembrance of his brother. How can I say no?”

    When asked why he wanted to get the tattoo, Gaquan said, “Because it represents my brother.”

    Napier reportedly took the 10 year old to a tattoo artist in Smyrna where he got a tattoo featuring his deceased brother’s old jersey number (3) along with the words “Malik R.I.P.”

    Someone at Gaquan’s school noticed his new tattoo and promptly contacted authorities. The mom was arrested Tuesday and charged with misdemeanor cruelty and being a party to a crime.

    A 2010 Georgia law states: “It shall be unlawful for any person to tattoo the body of any person under the age of 18, except a physician or osteopath.”

    Napier says that as a parent, she should have the final say so about what her child gets tattooed on his body.

    “I always thought that if a parent gave consent, then it was fine,” Napier said.

    “How can somebody else say that it’s not OK? He’s my child, and I have the right to say what I want for my child. I can’t go tell anybody else what I want for their child,” Napier said.

    Napier bonded out Wednesday and plans to fight the charges. The artist who gave the tattoo is also under investigation. (source)

      Being arrested was extreme, especially since her reasoning for allowing it came from a good place and she wasn’t just being a negligent parent. If its a law and they want to enforce the law, then the parent should not be held accountable it should be the tattoo artist. The tattoo artists should know better to refuse this work to minors under any circumstance. If I send my child to the store for a pack of cigs then the store clerk would be at fault if he/she served the minor, not the parent who consented to have the child buy the pack.

      Seems that someone was overzealous in having her arrested. If the statute is accurate as quoted, then the only the tattoo artist can be charged. A parent can give consent, but if tattooing someone under 18 is illegal, then the tattoo artist should be aware of that. It’s up to them to refuse to perform the act;inform the customer instead of being blinded by dollars. No where in the statute does it state that it’s illegal for a parent to sign a consent form. The consent form itself is null and void, if the act itself is illegal. I guess it should be no surprise that this happened in Georgia, since there is a recent history of stupid actions on the part of law enforcement officials, like charging a parent whose child struck by a car(which someone else was driving) with homicide by vehicle and charging a young man,who was the recipient of consensual oral sex, with aggravated sexual child molestation. The ‘justice’ system in GA is riddled with ignorant people who seem to be unable to interpret laws or who interpret the law to fit their biased agenda.

      Although I was 30 before I got my first tattoo, I do understand her reasoning for allowing the little boy to get the tattoo. I have lived in a house of mourning before, and know that when grieving we sometimes make bad decisions.

      I thought as long as they had the parent consent it was okay. I think arresting the mom is extreme after all they have been through with losing her son to a drunk driver. Although I wouldn’t allow my son to get a tattoo under any circumstances.

      I van understand what she was TRYING to do but her decision was indeed ignorant. If it was my son I would have told him “not now honey, at 18 you can get a tattoo to represent your brother but for now let’s think of something else we can do as a family to remember and celebrate his life.” Kids aren’t old enough to make these kinds of decisions. We’re supposed to be smarter than them and guide them.

      In my opinion if my child asked me at that age I would have said wait until your either in high school with my consent or eighteen. A mural could have been painted on his bedroom wall until he was of age to get one. On arresting the mother it was extreme. The law for which I have read in several tattoo parlors is that no one under the age of eighteen is allowed to get a tattoo unless the parent or guardian is there with proof of being the under age child parent or guardian to sign consent forms.

      I understand wanting to please your kids and feeling compelled to do so under the circumstance he wants to remember his bro butttt you are the parent (adult) you should of sat him down acknowledge what a wonderful thought he had but son we must decide on another way a tattoo is totally out of the ?       Honestly….Americans underestimate children,and shelter them WAY too much. Due to being in the military i know There are MANY things i have seen children do in other countries that we wouldn’t even allow our children to think about. Children in Thailand are allowed to get sex changes n become Lady Boys…a tattoo ain’t NOTHIN. Hell…ppl change the sex of their kids in the womb now,as well as alter other things such as hair color,eye color. How do we know they wanted those things changed??? Just because they’re children doesn’t mean their thoughts,opinions,and decisions should be over looked. Nothing is natural these days. Im not saying i would allow my son to get it…i’d say wait til you’re a little older,but im not about to down ol girl cuz she was being a free spirit and wanted to comfort and support her son the best way she thought fit. It might hurt so bad he may not get anymore and become a statistic like most of the black males COVERED in tats. Maybe he might not like it as he gets older…im trying to be open minded. She could be the BEST mother in the world and everybody just faultin her cuz of one bad decision. Another note…if they can death row kids…they should be able to tat them if they’re willing.

      This is ridiculous. How different is it than getting your baby’s ears pierced? You leave a permanent hole in their body and their blankets get tangled in them at night and they end up ripping them out. I might not choose to do it to my son, but get her out of jail already.

      Uh darling, holes in the ears close up on a baby once you stop putting the earings in. I had my ears pierced at 7 and stopped wearing studs at around 9 and the holes closed up and I’ve never looked back. Injecting permanent ink into the layer of skin below the epidermis is a serious procedure and the process of removing the tatto is far more painful. Comparing baby ear piercings to tattoos is just ignorant.

      If she wants to tat herself in rememberance of her dead son that is one thing but to permanently ink her 10 year old who is probably just mimicking her and the other hoodrats around him, is inappropriate. Did she ensure that tattoo artist was legitimate and licensed?

      Hepatitus can be transmitted via tattooing and she put her son’s health at risk. Frankly, they all should just surround themselves with photographs, videos and other sentimental items that don’t involve marking themselves like some damn gang members.

      okay why couldnt she just get it air brushed on him every month..that would seem more logical. My daughters are over the age 18 and i still tell them no tattos..they can say im do it anyways but the respect me enough to know that a tat is permanent and you cant take it back..you never know when it comes to jobs and even though you might think you can hide it, employeers these days dont want to hire you with tats or piercing..but her son his future..

      The "mother" was out of pocket and BELONGS in jail. Parental are supposed to be smarter then their children. What mother thinks its ok to tat the young skim of a GROWING boy? And that tattoo design looks cheap and busted. He’s still growing. That tat is going to look like a stab would by the time he’s 20.

      Bad parenting at its finest. Oh… And the fact she gave ok Is irrelevant. There are parents who allow their children to smoke, drink and swear. They too ate out of line. That’s why we have laws like this on the books, to rotect children. And I couldn’t be surprised if that tat was a hood hookup. No real tattoo artist would dare put their licence at risk over some hoodrat and her son. Next time get an airbrushed t-shirt.

      that’s why the U.S. is all screwed up now…ppl focusing on the wrong stuff…..in other countries ppl allow there children to do way much more and there is no problems. Drink alchol, smoke weed, have children, marry young etc…why can’t ppl in america let ppl raise there own kids….as long as the child is happy why should anybody care…atleast his mom cares about him and how he feels…too many parents in the club or running up behind someone and not paying any attention to there kids, killing them, abusing them etc..give the lady a break….the law need to be more specific.
