On episode #11 of The Real Housewives of Atlanta (season 5), we learn more about the “Donkey Booty” business with Phaedra Parks and her husband Apollo Nida.

NeNe Leakes, and her on again fake ex-husband Gregg, settle in to their Hollywood home, while Kandi Burruss throws her boo, Todd a birthday bash with a special surprise guest.

First, I’d like to preface this recap by saying that I DO NOT have anything against Kenya. She is just clearly the easiest target at the moment. That being said… let’s dive in!
Thankfully there wasn’t much talk of Walter, so Episode #11 was all about the booty! Phaedra’s booty, Apollo’s booty, Kenya’s fake booty…

it was all there on the tube tonight for our view pleasure. 
Coincidentally, Phaedra and Apollo followed up with a previous meeting they had with the former pageant queen about producing/distributing their “Donkey Booty” workout videos.
You may have noticed that Kenya and Phaedra never actually came to a formal agreement for Kenya’s services. Parks even stated during the episode that Kenya had used her name without her knowledge and she felt her doing that was a bit “presumptuous”.
Kenya tells Phaedra that she wants a percentage of the “back end” of the video.
Parks clearly starts to feel a bit hesitant about using Kenya’s proposal, so she discusses it with her attorney and also asks Todd Tucker, Kandi’s boo, for his take on the situation since he’s in production as well.
When Phaedra tells Kenya her reservations, we see that look from Kenya that we’ve become so accustomed to when Porsha Stewart comes into a room.
And speaking of Porsha, she didn’t have much of a role in this episode, but she & her husband Kordell appeared briefly…

Moving on…
Kandi throws a birthday bash for Todd and surprises him with a special guest… his mom! It’s clear that Kandi and Todd are well on their way down the aisle and it’s great to see Kandi with a man she can finally trust as a partner in life.

During the birthday party, Kenya decides to go behind Phaedra’s back to woo Apollo and find out the deal on why Phaedra has changed her mind about the deal.
Moore also makes a beeline to Todd & Kandi to discuss the situation as well and Kandi shuts her down since Kenya is clearly being “inappropriate” as Cynthia Bailey would say.

I’m sick of hearing this mess come out of her mouth..My God at some point the thought may enter her mind that she’s making herself look like everything except an “Attorney”…This is one of the reason why black women get looked upon they way we do.
Kenya wanted a MOU (memorandum of understanding). Phaedra asked for a budget first (you need this for a production proposal). Kenya put together a budget AND took it upon herself to secure a distribution deal(which is separate from production) deal by name-dropping Phaedra’s name around the industry.
Phaedra never said that she wouldn’t pay Kenya for producing–if she went with Kenya. Phaedra said she wasn’t going to pay Kenya on the back end (back end is all distribution) b/c it had nothing to do with Kenya. Phaedra didn’t ask for Kenya to do anything beyond submit a proposal for production. Kenya played herself (again) & got mad. Nobody gets paid for submitting a proposal in business.
I think that both were "vague" in their communication…at least what was shown.
I am not the least impressed with Phaedra’s legal astuteness and wonder about her competency. To date, the only thing that I’ve seen of Phaedra’s legal abilities is to represent a small-time marijuana dealer who paid her under the table.
You think Phedra is a dummy? And by law she cannot show all her clients on television stupid. The is a law called Attorney–client privilege is a legal concept that protects certain communications between a client and his or her attorney and keeps those communications confidential.
Learn the law or shut up. Phedra is no dummy at ALL. If a marijuana dealer paid her under the table on national television she would be disbarred from practicing law by now.
Phedra is a reserved women who does not act on emotions, she knows how to play her chips with logic. That is why you see her pause a LOT before she speaks on anything. She is a thinker. More women should learn this concept.
Black people are so naive about business and this is why they stay losing and cannot function in the business realm. ALL BUSINESS DEALS ARE LONG AND MESSY AND THEY CHANGE. Business is not a stream lined concept of I agree and you agree to one said concept.
You people need to learn that BUSINESS IS WAR. There are no mutual friendships in business unless you are recognized as business partners under state and federal law. Phedra has to the right to change, manipulate, alter, be shady, disagree, or agree to any terms she chooses until it’s in a contract form.
There is no contract, only a negotiation. She can manipulate it how she chooses. You people need to learn business concepts 101. I don’t see nobody complaining about the messy deal that about Apple suing Samsung. When Samsung manufactures 24% if of the Apple I-Phone.

I think the editing led some unfamiliar with industry lingo to believe Phaedra wanted something for free. Not a huge Phaedra fan, but the editing did create the illusion that she’d asked Kenya to do all this, AND that she wanted it for free. When it comes to paperwork, deal making & networking… I’ll take a law degree over a pageant sash any day.
Well she did want Cynthia to cast for free. She sent out a tweet with out Cynthia’s knowledge directing people to come to her agency then looked surprised when Cynthia mentioned casting fee.
I think we all caught that…Kenya tried to put her hand in the cookie jar : ) without securing that in writing with Phae and Apollo or even verbally… But, Kenya put way to much trust in them too….The Game is To Be Sold…Not Told. lol

But, here’s my thing…you really can’t beat experience and industry connections…which I’m sure Kenya has. Also, it cant hurt to have names like Kenya Moore and Cynthia Bailey approving your product so to speak, especially a workout video..since they are both gorgeous and fit. and have Donks of their own. So, I think Phaedra should have looked at the bigger picture in that. I think all three of their names on the project would have been a good look. But, maybe Phaedra is a little salty with Kenya over Anguilla.
i absolutely agree with u…..we all know kenya is a bit crazy and im not a fan of hers but im with her on this one…..basically,pheadra is saying im not paying u for the distribution gig u got for us…and that is a no no,without distribution,u cant get those dvds out there and with kenya’s experience and popularity,she managed to secure a good deal on that for u….and now u saying ‘im not givint u a cent on that’???? cm’on,where they do that at?? even apollo understands where kanya is coming from and agrees with her…..and she(pheadra) literally said "we all work for free,i’ve worked for free",that is unacceptable….u want the deal but u dont wana give her anything from the deal??cm’oon nooow pheadra. this reminds me about when phaedra was the executive producer of the "tiny and toya’ reality show.. toya (lil wayne’s ex wife) wrote that book.. phaedra helped got a publishing deal for toya’s book but for some reason toya fired phaedra as her attorney and manager. and toya hired new attorney/manager.. im sure there is good story about it.. so in my mind.. first toya. then sheree, now kendra. as phaedra would say "everybody is not gonna tell the same lie about one person. something in the buttermilk ain’t clean" phaedra got some shady practices going on.

I am not too sure about that. The way I see it the rumors are strong that the marriage is on the rocks. So Phaedra has another baby with him cause she dont want "baby daddys" but wants two kids. He does really have a job, trade or profession so she sets him up with one and on the back end she will get child support from him plus her percentage of the video. You cant get blood from a turnip (love the southern saying).She is in mortuary school and is involved with other events in the ATL area. The writing is on the wall. She may not be in law very much longer unless she handle a couple of small cases or use her name and become an ambulance chaser like some other attorneys.

So basically you’re saying you believe Phaedra is setting up for a split? I had that same thought when I heard she was pregnant. I figured, she probably wants her two kids with the same father before they divorce. (That, or she thinks it’ll keep him around longer) Plus, since he has a real career option now, he won’t be a deadbeat. Seems like their whole marriage was just for looks anyways.
I think Phaedra has a craving for bad boys. Plus she has a cute one. She is all about looks and the preception of. So I think she got with Apollo so she could have her bad boy and "Pretty Babies".
I am hoping for the best for the. Never want to see anyone split if they can work it out. My grand parents generations friends rarely ever divorced, may have seperated for a while but always found their way back to each other.

I agree, Phaedra was trying to see how thirsty Kenya really is! If she could pull a Kim on her, that’s what she was going to do. Pretty damn much. I mean $5000 fee was cheap as hell, but 100k for production+ percentage for an excercise video that may not even gross 100k because Phae and Apollo aint celebrities like that. We really only want to see them on this show. And if you ARE a Black woman(because we’d be the only one’s buying it cause unless you dancin’ and singin’ them other folks don’t patronize us) then you should naturally have a donkey booty. What I DID notice was how Kenya’s neck had swollen and she was hoarse again. Does she go someplace and have screaming fits or does she have a thyroid problem? Yes I agree! Kenya is broke because anyone else in their right mind would have just said to hell with it, but she was so pressed! That 100,000 Kenya was charging was for her to get back on her feet..and there’s nothing wrong with that. We all know that the video would have sold few copies. Let’s be real the only winner in it would have been Kenya with the upfront 100,000 she was asking. Kenya knows it wouldn’t do well that’s the reason for her requesting such and exorbitant amount upfront. It doesn’t take 100,000 to make a exercise video. More importantly why would you spend that much on a video when you don’t even know your demographic and how it would be received. Kenya wasn’t willing to negotiate and Phaedra wasn’t willing to accept the terms, there is no right or wrong person here so for those of you siding are immature and have no business sense without getting personal. Phaedra was going to pay just not what Kenya was willing to accept. It’s about negotiating a deal that will benefit you the most. It would have mainly been beneficial to Kenya. Why should Pheadra accept that if she knows she wouldn’t benefit from it? Point blank. I ain’t mad at Kenya for asking for 100,000 upfront but if Phaedra would have paid it SMH she would be a damn fool. You can’t be mad at Phaedra because 100,000 is a lot of money to part with especially if there is a chance and I mean a very good chance it won’t sell. Well, whatever ..it is about a side. Cause, Kenya could have asked for a cut of the royalties up front and she also SHOULD have asked for consultation fee’s up front. But, she didn’t. Phaedra could have said No, Kenya we just want you to shoot the video and help with casting. We don’t need help with distribution or anything else…up front or at the point when Kenya offered a distribution deal. But, she didn’t. But, after Kenya gave them names(distribution co.), ideas, and put in foot work…they decided not to work with her at all. There should have been a price on everything Kenya did. PERIOD she does have the right. It’s call having the knowledge of what it takes and having the experience…all that has value and should have ONLY been given with a price.
Kenya was doing way too much without it in writing or any clarity that makes her a fool! Do I feel sorry for her No! I’m not doing a damn thing without a contract drawn up. If you recall a previous episode Pheadra said "Money is no object, I want the best" when Kenya asked her what her budget was. That 100,000 doesn’t go in Kenya’s pocket it goes to build the set, pay crew (who don’t come cheap. The production company I work for charges 71$ hr for their INTERNS and up to 250$ for Executive producers), rent equipment, pay talent, editors. Yes you can do it for less and with less equipment but Pheadra is the one frontin like she paid. Very little of that would go into Kenya’s own pocket but the little she would see from the 100k would go back into the business to keep it running. You might not have caught it cause words kept flyin messy but Kenya mentioned in the parking lot how the "fee" Phaedra wanted to pay her for everything was less than 1,000 (as she couldnt even buy 1,000 shoes with what Phaedra wanted to give her). Making a cut on the back end is how most people in production get there money. This is for video, tv, movies, EVERYTHING. A lot of actors as well do not get paid much up front but know they will get paid once it distributes because they get a cut out of that. I cannot tolerate Kenya’s general attitude on most things but girl knows what she is talking about when it comes to production. Honestly I don’t think Phaedra realizes just how much it takes to produce.
I remember Phaedra saying money was no object too. But as experienced as Kenya is, she should be able to use her contacts to get a great deal for the project. 100000 dollars is a lot of money! It was way too much. Kenya claims to have been running around busting her ass…she should have used that times to research the target market to realise that they would struggle to break even with such a high production cost.
A fitness video could cost $5000 or even a million dollars. But when it becomes a business venture and you are hoping to make money out of it, you have to look at your market to see what budget fits best.
What I did not like with the way the whole business was handled was how Appollo was left to look on like an accessory. Phaedra needs to get him more involved in important decisions.
Which probably explains why she and Apollo did it (production) themselves. I see his name is the so-called production company. They’re fronting.
You are 100% right about the backend percentage. Most actors,directors, producers, etc…get a backend percentage of the project to make their money.
Kenya said she considered Phaedra a friend so she did not go the usual route with the pre-production work and contracts…her fault. Live and learn
This type of video takes no more than 15,000 to make, and that’s on the high end. I’ve produced to many of them. If Kenya’s production company is all that, she should know how to keep the costs down. You use a gym, borrow two camera’s from colleagues, borrow props (or rent them), get the right lighting (also borrowed), cast FRIENDS and FAMILY to work out (no more than 4) and set a day aside. There is no way that costs 100,000.00. Kenya padded that figure and didn’t think they’d challenge her.
This episode really exposed Phaedra for the con artist she really is. I have never been a fan of hers because I can smell bullshyt a million miles away and living in Atlanta, the bullshit meter tends to get sharp and Phaedra is a perfect example of it. People always expect others to work for free and not pay what they’re worth. That’s not negotiating, that trying to get over.
The show didn’t give details of the deal, but there’s nothing wrong with giving Kenya 10% of the sales if that was all she wanted. Even if she had a flat fee + 10%, I think that’s reasonable.
I’m glad Cynthia shut her down about using her spot without ironing out the money. Phaedra is all about her money, but when it comes to her paying other folks, she tries to weasel out of it. I can’t stand greedy people like that. I see the video actually is under Apollos name, so I guess they were too cheap (or broke) to pay for professional production services.
But, the biggest money that their going to make is from the video sales. that’s why the 10% for the life of the video is major. I don’t know if it’s reasonable…but to not give her anything…seemed a little shady. Maybe 3% or 5%. I guess we would have to really see what Kenya was asking for. To know. the editing on that was a little …suspect. lol
But, listen I’ve never heard of a butt growing from working out. LMAO I’ve heard of toning up a donk…lol But, it’s tv.
Chile its all a scam. As much as I think Phaedra is a scammer and schemer, if people are crazy enough to fall for it, then so be it.
I can see 3%-5% if this video was a guaranteed blockbuster and was going to sell at least 1 million copies, but we know its not. For some little piddly workout DVD, that MIGHT sell 10,000 copies, 10% is only $1,000 which is nothing so I understand Kenya’s figures.

That depends on how well the video does though. Often people do not have enough money to pay the production company up front for their services on top of the actual production costs so its very standard for them to get a backend. It’s actually rare if they don’t.
I’m sorry but being an attorney you already know you pay like you suppose to pay. If for nothing else Atleast for the 6wks Kenya has already done for you. 10% is more than fair. How can anybody agree about someon. Trying to get over on somebody like that. No matter where Phadrea and Apollo go they are going to pay. Unless the other party agrees to do it for free. Sorry but that was wrong all the way around.
Well, maybe Todd will do it for free. Since he is building a company. But, Kenya is established…people can pretend like they don’t know who she is..if they want to. lol She had every right to ask for fee’s and profit. You’re not mistaken. You are absolutely right! I just can’t wait for all the details come out about this. People seem to think Phaedra is manipuating Kenya, but it’s quite the opposite. Phaedra is a very smart business woman. Kenya should have handled herself more professionally and communicated more clearly. Nothing was written in stone, but Kenya destroyed any possibilies of being considered for the job after the way she handled things with Phaedra in her office and at the Bailey agency. She can’t seem to secure a man or a business deal properly. And she’s so fabulous!
Kenya is NOT a true business woman because if she was, she would have gotten everything in writing prior to doing whatever it was she did for 6 weeks. Who does that? Phaedra is a hustler and Kenya got hustled. Apollo forgot where he laid his head at night…

Well I must say that this episode was really interesting! I hate to say it, but the scenes with Nene were boring. Nene is hilarious though. That was nice for Kandi to throw Todd a surprise birthday party and fly him in the building…cool idea. It will be interesting to see how long Todd stays around. Porsha is still boring and useless. Now onto Kenya and Phaedra. I am 100% with Kenya and even Cynthia on this one! Phaedra’s commentaries are funny but she just gives off this fakeness to me. If you remember her from past seasons, she constantly contradicts herself. LOL. Apollo acts like he doesn’t have a mind of his own, although he is attractive. If you look at tonight’s episode, he went back and told his wife at Todd’s party what Kenya said like he didn’t have an opinion on his own. Maybe Phaedra really is bossy! I just can’t wait to see next week’s episode. I tell you Miss Kenya is keeping me entertained this season and her performance on WWHL was just hilarious. She’s riding all the way to the bank no matter how crazy she comes off!

Kenya initially asked for $100,000.00 Phaedra’s lawyer advised the amount was inflated, didn’t need that much to make a video. If you hire an electrician to install wiring for a business you pay the cost of the work. Once the business is up and running the electrician is not entitled to any profits that business makes. KENYA IS NOT A BUSINESS PARTNER. If I’m wrong excuse me, Kenya wants the money she originally asked for and 10% of the sales..KENYA HAS FULL OF S T-ITIS! My understanding is that Phaedra planned to pay Kenya all of her money up front (i.e. $35,000) and didn’t want Kenya to get 10% of the back end royalties. Kenya acted as if she wasn’t going to get paid, but she would have gotten paid up front instead of being paid both up front and post sales of the dvd. I can see both sides. I can see Kenya wanting to get as much money as possible from the deal, but I can also see Phaedra feeling as if Kenya doesn’t deserve 10% because Kenya didn’t come up with the concept of the video. The entire concept was done before Kenya even came into the picture, so Kenya is basically just providing a camera and links to distribution channels.
With regard to the men on the show, Kenya needs to pull back.

While Kendra def needs to revise that budget projection, Phaedra is the supreme shady one. Kendra has allusions of grandeur for how much money this video might gross for sure. She also wants to overcharge for services she cannot deliver.
However, the real issue is that Phaedra again proves she is not a smart businesswoman – she is a conniving businesswoman.
Notice how she also wanted to use Cynthia without paying her a scouting fee.She also wanted to use Kendra. (Of course, all of this is fake becuase Kendra has no company)
Phaedra tries to get over. She is not necessarily smart. She is just your ordinary con man with a law degree from a mediocre law school and a husband who was willing to take the fall for her.

I am on Kenya’s side with this one. Now usually Kenya is doing the most but this time I think she was right. BUT where she went wrong was thinking that Phaedra was her friend. She should have had someething in place before she started doing work for them. But Phaedra was wrong for leading her into believing she wanted to be partners. IF Ms. Phaedra was smart she would have jumped on Kenya’s offer because even though she is not a movie star she she has tons of more experience than Phaedra’s ole shady ass. Cause ain’t nobody getting no damn 10 percent if the video is cheap and cheesy looking. #BOOM AND nobody does work for free. If you expect to get this video produced and distributed on a major level you will have to give up something on the back end, period. She should have kept it in the family cause the white man cause eat ur ass up on the back end, lol. And is it me or does everybody else wonder why Phaedra is talking to Todd who can’t even fly his mama out but you want him to produce your video? I GUESS….

Wow I am shocked at how many people are siding with Kenya on this one… Kenya stated that she spent 6 weeks working on a business plan for this DVD…well in most situations you have to come up with a plan to be presented for approval before the contract is signed. You don’t get paid for that time(unless that is in the agreement) and in some cases you very well may not be the company they pick, especially If someone comes along with a better/more affordable proposal like Todd did…such is life. The fact that she gave them a budget that included her fees meant that she would have gotten paid. The fact that she kept implying that they didn’t want to pay her was a lie. NOW while I thought that it was great for Kenya to show initiative to find a distribution company she # 1 admitted that she used PHAEDRA’s name to get the company interested and #2 SHE decided to add herself as a business partner and wanted to get paid on the backend (sales)…ummmmmmmmmm where they do that at?! I don’t think she should have gotten paid on sales unless that was the original agreement. Kenya and this attitude of entitlement rocks my soul. I didn’t hear anything about her putting on her workout clothes and dropping it on the DVD THAT gets you paid on the backend…get out of here Kenya! Lol Also I must say I thought it was extremely shady that she was running around Todd’s party trying to get sympathy from the men. At the end of the day Phaedra and Appollo are married and her trying to talk to him alone wasn’t cool.
Say what you want about Kandi…you can call her a sugar mama, freaky mama, hot mama, or a stanky mama she seems happy and when it is all said and done that is what really matters. I hope it last.

Kenya clearly showed NO business savvy. I don’t understand when Phaedra approached her about producing the video, she should have brought her proposal. This is why she looked foolish. Was it a formal bidding process? I don’t think Phaedra put out an RFP or RFQ or even indicated to Kenya that she was going to shop around for other companies until Kenya did all of her groundwork. I believe Kenya thought she was going to be the production company, which is probably why she went on and did all of the extra work of finding a distribution company. At the end of the day, neither one of them knew what they were doing or handled it correctly.
I’m sure that things could have been done better in this situation on both ends… but you dont have a solid agreement until papers are signed. I think it was smart of Phaedra to let her know that she was going to have her attorney look over everything especially once they received a budget that was too high. Clearly Kenya heard money is no object and ran with that. Any good business person would have still looked for the most economical avenues to make this video while still producing a wonderful product. Kenya is an opportunist and will look for any way to come up regardless to who she has to step on…she probably was charging the distrabution company a "finders fee".lol

Editing made that very confusing but Phaedra was completely in the right! First off Kenya did all of that including get a distribution deal without a contract. That right there shows you the kind of business woman she is. When you are still negotiating a deal you do not put all of you cards on the table. She kept saying she’d work for six weeks and was not getting paid. Who does that? That should’ve been taken care of from the beginning.
Kenya is also trying to imply that Phaedra was not going to pay her. No that is not what was going to happen! Phaedra was going to pay her a flat rate for the production of the video. Because she secured a distribution deal, that Phaedra had not signed on to yet mind you, she thought she should get a piece of the sales of the DVD. Pheadra didn’t agree b/c she felt her name and likeness would drive sales and Kenya shouldn’t get a cut of that. A fool Phaedra is not…

The only person Phaedra tried to play was Cynthia with the free casting….Kenya played herself…they were going to pay her a flat fee but not anything on the back end…meaning distribution….that was their own option on who would distribute…not up to Kenya…

My hubby is a mechanic. BAY-BAY, a mechanic will give you an ESTIMATE. Technicians DO NOT work w/o the OK of the boss. Whether commercial aviation or vehicles. He is a craftsman…He does great work. He will NOT refurb your busted ass boat, chevy or Cessna for free, because you are a friend. You will get an ESTIMATE until you OK the estimate and agree to a mechanics lien on your vehicle…except aircraft, that -ish is too complicated legally…

Also, those negotiations should have occurred between Phaedra’s lawyer and Kenya’s lawyer. Kenya looked like a fool! A true business woman does NOT talk in circles and WHINE that "she deserves a backend." She talks marketing and distribution strategies, shows EVIDENCE of her successes. She should have been talking numbers. Instead of whining "I usually get 50%", she should have said I produced a film that grossed XXM. I agree with Phaedra and Apollo, she should invest on the front end to get paid on the backend. Instead of whining, she should have negotiated.
Employees, CEO’s, etc. either get paid in stock or get a discount on BUYING company stock. You don’t get a share of the profits on the backend because you work for Apple! Negotiate a bonus for units sold…you believe in the project INVEST. Don’t ask for 100K for a 30 minute video, then expect MORE once it’s over. Yall really believe a 12-18hr shoot, some fitness models and editing cost that much? Puh-leeze. PLUS, she could distribute on iTunes, amazon or sell it to Netflix. I can’t believe so many people ride with Kenya on this one. I might slow down to 15MPH to boot her out of my ride is she talked this -ish to me.

I agree with Phaedra. Kenya should have obtained a contract before trying to secure a distribution deal. If Kenya doesn’t work for free, she shouldn’t have done all that extra work without payment.
Case in point – check out Cynthia’s comments. She said upfront the casting has been canceled. I don’t cast with a casting fee. She didn’t agree to do anywork without a discussion of payment. That’s why Kenya should have done.
I agree with some of the earlier posts. Folks have to read up, study, etc. on how business is conducted. Ex. If you want to sue someone and aren’t sure about your case, there are some attorneys who will allow you to speak to them for one hour for free. I’ve done this myself. The attorneys are quite clear about this and time the conversation. At the end of the conversation, the attorney will say whether you have a good case and what are the chances of a ruling your favor. If you want to proceed, the attorney will state these are my fees and a contract has to be signed before they agreed to do any work on your behalf. That is what Kenya should have done. Get the payment and fees negotiated and then sign a contract.
Phaedra is an attorney. Kenya didn’t keep that in mind. Her thoughts were we are friends. But what did Phaedra say to Apollo "we havent’ been friends that long". That says its all. Business and business. Friendships are a separate thing. Kandi made that mistake with Kim.

BRAVO!!My sentiments exactly. Kandi’s net worth is somewhere in the are of 35-40 million dollars, more than any of the other ATL cast members. "Balling on a budget" allows her to buy two million dollars homes in cash and renovate them to her liking. Who else can do that. Todd’s net worth – 200 – 300k, but Kandi did make it a point to say she NEVER wanted to date anyone in the industry (singers, actors, etc.), so if that makes her a sugar-mama – then that’s her title to claim if she wants to. But it saddens me to see so many negative comments about her situation rather than being happy that she’s happy. She deserves it.
Phaedra did help Sheree with some legal advice in the beginning but later told her if she wanted to continue with her services then she will need to retain her. She helped a friend out but wasnt foolish enough to work for free.

Please bear with me, this post might be long, but I think it will give a better understanding of who’s right and wrong. I feel as though I can speak on this because I have a small production company. I produce various videos for my church, and local cable shows so I’m familiar with the topic.
I can only address what I saw on the show, but knowing what I know about producing, Kenya Moore is totally in the wrong.
She showed her behind when Phaedra would not agree to her “demands”. Kenya is a very business savvy woman, but when you are in business, you negotiate terms of a proposal YOU submit to a potential client, if all parties agree upon the terms, then they enter into a legally binding contract.
Due to lovely editing, viewers do not know is WHY Kenya Moore was asking for 10% or WHY Phaedra and Apollo had a problem with it. Kenya Moore was trying to brand the video (using HER brand) by gaining the 10% backend. If she managed to do that, she’d get royalties if the project becomes a franchise. Franchised projects like this video are ones that are continued over a period (i.e. made into a series of videos), remakes of the video, or become the stepping-stones for other ventures that can be directly related to that ONE video. Kenya would have gotten 10% of it all. In the business world, 10% is legal ownership. Kenya wasn’t just trying to produce the video; she was trying to get 10% ownership (back end).
She also, in her own words, dropped A&Ps name to a distribution company without consulting her POTENTIAL clients. Hence, Phaedra saying it was a bit presumptuous since they had not entered into any binding agreement. It is very possible that Kenya already knew this distributor, because you just don’t walk into an office and come out with a deal, no matter whose name you drop.
It was for THAT reason that Phaedra is NOT shady, nor legally obligated to pay Kenya ANYTHING. Kenya acted on her own free will and did “pre-production” work without a contract.
Even though she blasted A&P for not paying, she wouldn’t talk about it other than to say negative things. Kenya WAS NOT asking to be paid for the work she did, she’s asking to be an owner and get 10% of all the profit from this video and any others that would come after that – like a series of workout dvd’s.
If this were true, Kenya would have been paid for her services in general, shared in the profit with the distributer and gotten a 10% back-end to collect royalties for whatever period they decided on (contractually). She would have stood a better chance of asking for 10% of the GROSS.
Kenya can’t be upset that Phaedra talked to Todd, what he told her was right. On a workout video – no more than two cameras are needed, unless you’re trying to do The Matrix.
She also told Cynthia that the upfront money was coming from her budget, not A&P’s. If I remember Phaedra told her money was no object in getting the project off the ground, meaning A&P would absorb the upfront costs.
Phaedra was right, Kenya doesn’t deserve a back-end, why give her 10% ownership? She was right when she commented that they never said they would not pay her. Kenya cannot have it both ways, she wants money for work she’s done already (without approval or an actual client) or she wants to enjoy in the spoils after the fact.
Also, working with friends is a huge no-no! I’m very disgusted with the way Kenya totally turned and began the insults and name calling. I’ve had friends that I’ve tried to work with, but we agreed only to work together if there was a mutually understood and satisfactory contract in place. Instead of acting like a spoiled brat and since "this is where she shines" she could have sat there and negotiated the terms like a sane person. She could have drafted a new proposal and gone from there. Don’t give people the wrong impression of you not being paid for your work when you haven’t done any. Personally, if it were me, I’d try to make the deal work in the interests of my client because I know the distribution company is going to eat up most of the profit. Producers can ask for a back-end, but that’s only if it’s a small production company and they needed to get financing by way of investors for the project, a back-end is a reasonable request. If A&P were financing their own project, Kenya wouldn’t have had to come out of her budget so she’d have no costs to re-coup. Even if THAT were not the case, producers generally ask for 2%-5% back-end, not 10% ownership.
