Raymond and his ex-wife Tameka Foster Raymond appeared in Fulton Court court yet again to hash out additional details of their child support agreement.

As you know, Usher was awarded Primary custody of the couple’s two young sons but Tameka’s attorneys filed two motions that allowed the original joint custody order to be stayed temporarily.

Today’s court hearing was held to address those motions and the judge allowed each side a few moments to express their concerns.

The hearing held this morning only last a little over an hour, and I was there as the two sides presented their arguments to the court.
Fulton County Judge Tipton-Lane was asked to recuse herself from hearing the motion for new trial due to her “financial relationship” with one of Usher’s attorneys, John Mayou. Tipton-Lane refused to recuse herself, so Tameka’s attorney was forced to present her argument that the judge was biased to…. the judge that they were saying was biased. *sigh*
It was argued that Tameka’s due process was violated by the judge and John Mayoue’s non-disclosure.e.

Tameka’s attorneys spoke of the inconsistencies with the judges ruling, stating the it was “inconsistent with the evidence presented” as well as that it was “inconsistent with the psychological reports obtained”.
It was also brought to the court’s attention that Usher INTENTIONALLY failed to disclose that he had secured a position on “The Voice” – if you recall, the news of his joining the show was made within days of the final hearing.

Another issue brought up to the court was that Usher had been out of the state 17 days in these 24 days of October 2012 and that it was undisputed that he would NOT be in town at least 70/80 percent of the time.
During the original trial, Tameka’s side requested Usher’s schedule and the judge never ordered him to produce it. Her attorney surmised that they needed it to prove he was lying about being able to maintain primary custody in the state.
In the original trial, Usher maintained he had a “village” to help him care for the children ie his mother, grandmother, aunt, new girlfriend (?), however, those people never appeared before the court for the judge to determine if it was actually in the best interest of the children.

Usher’s refusal to pay attorney’s fees was argued as well. As it was his decision to bring forth the original action seeking SOLE custody, and that Tameka had won 3 of the 5 contempt charges that were presented to the court, it was argued that her attorney’s should be paid by her ex-husband.

Usher’s attorneys argued that he had already paid $25,000 to Randy Kessler (Tameka’s former attorney), and West (Tameka’s current attorney) argued that they did so with no issues. Now that she has requested payment, Usher’s attorneys were refusing to pay additional funds, suggesting that the $25,000 should have been reallocated (where they do that at?)

At any rate, the main issues brought up were that Usher lied to the court about his deal with The Voice, originally stating that he was in negotiations with an unnamed show that filmed in ATL, NY and LA (and it was noted that The Voice only tapes in LA and he knew that) and that the judges order ruling that he be granted primary custody was totally inconsistent with any evidence presented to the court, i.e. Tameka was not found to be psychologically unfit and there was no evidence presented that would otherwise suggest she was unfit.

Here’s the thing… No… I don’t think that it’s wrong for a father to want custody of his kids. But the judge clearly stated in the original order that “it’s NOT in the children’s best interest” to be on tour with Usher and yet… she ruled to give him primary custody knowing he would be going on tour. Oh… and he LIED about his schedule are refused to reveal it to the court (but that’s beside the point, right?)
Judge Tipton-Lane is expected to rule on the motions this week and yet again… what this all boils down to in my opinion is dollars and cents.
Will Tameka ever get a fair trial? Only time will tell…

I do not know or care about the particulars of Usher’s relationship with his ex wife Tameka. I do know that she is not listed as an unfit parent. This seems to be Usher exercising his financial muscle to hurt this woman. The fact that their marriage didn’t work should not affect their abilities to think in the best interest of their children. A touring father who will need to leave the children in the care of nannies and other family members is not what is best when the mother is healthy, capable and willing to raise her own.

Hey Ce…Tameka has been labled as everything but a child of GOD from "the world" I think that her fighting to remain a constant in her kids life is showing that she is the best parent that she can be. I personally wouldnt wait for time to tell if it came to my sons father having primary custody. I think that putting Usher and the Judge on notice is the best thing that she can do for her boys they need her just as much as they need their dad…speaking of needing dad…the going back and forth to court is not just about the voice. Since neither of them were found to be unfit there were certain factors that gave Usher an edge (setting the possibly of a pay-off aside) he claimed to have family help, two of those people dont even live in his state and he does not have the best relationship with his mother, the fact that he has been out of town for 17 out of the 24 days in this month would mean he lied about his schedule, which is probably why he wouldnt provide Tameka and her Attorney with a written copy. Cinco is in a structured school so I know they are not traveling which means he has only POSSIBLY seen his sons 7 days out of the month so far(the month is almost over lol)…that is not consistant with a dad who originally wanted full-custody. The fact is the Judge has yet to give a reason as to why she ruled in Usher’s favor in the first place…how can Tameka "fix" a problem that she dont even know she has? Let me also add people keep mentioning the kids…currently there is a stay on the new order (as Michelle mentioned) so nothing has changed for the kids as of yet. Hope this helps…
Hey Vay, I completely understand what you are saying, however, with the way things are looking it is highly unlikely she will get the kids at this moment. Plus, I can guarantee she will be stuck with all legal bills because she continues to bring suit after suit. It’s starting to look more like she is fighting for hersel and not the children. A problem can’t be solved in the same level it wad created. If Usher is the monster, it’s better to come back to this case in about a year when she has a stronger case. She is arguing over stuff that hasn’t happen yet. Use a year to gain supporting evidence showing: he’s on the road non stop, her time with them is productive, ect. Hell, for all this money she has spent she could have hired a PI. It’s not like he’s hard to get acces to…he is a male whore. Cases are built on concrete evidence not circumstantial. Take a step back and make sure they can’t deny you. Additionally, I ain’t saying she broke but case after case is going to leave her that way, then she really won’t be able to care for them. This is why her battle looks selfish. You have to find out the best way of attack before attacking. This latest court battle does not show that she is doing so. @Candi … Him traveling a lot when they were dating BEFORE the children were born vs. him taking her children God knows where, being supervised by God knows who, seeing God knows what is a totally different story. Also, all the traveling, paparazzi, fans, etc. isn’t good for the children. Lastly, it also brings a burden when it’s time for her to see her children. If it’s her time with the kids, based on the custody agreement, and the children are in Switzerland, it wouldn’t be fair to her or the children to have to go through that.

The kids have to be STABLE not floating about on tour. They are almost of school age. Touring has no life for kids, unless both parents are around like Jay and Bey. It doesn’t take a Rocket Scientist to figure out that Usher paid for this judge. Most judges are professional and act accordingly. Therefore, this judge should easily be able to see the totally obvious conflict of interest in this case; and then recuse herself.
And the only logical reason as to why this horrible judge refuses to do so is because she has a financial interest involving something or someone. Get it together judge. We can see through you. And to Usher: you will reap what you sow, rest assure.
I am severely confused as to why the right of custody is presumably a right of the mom only! He should be able to fight for custody of his children. The are his children too. She shouldn’t have to be proven unfit or put the kids in harms way before he is allowed to seek custody. That is ludicrous! Why would you wait until a child has been put in a harmful situation when you can prevent it from happening? This woman has a criminal past and does not have full custody of her other kids. I’m sure he has skeletons in his closet as well. I don’t think any of us can comment on who deserves custody as we do not know the particulars of the case, know their parenting styles or have a financial or emotional stake in their lives. MomOfThree….why are you severly confused? They had shared joint custody. Usher filed for SOLE CUSTODY which means he wants the children taken out of their home that they’ve lived in from birth, with their biological mother (who has not been proven to be unfit or abusive).
Shared custody is what is most common when couples divorce. To take small children from their mother & stable environment (save for 6 days out of the month) without any evidence of neglect or abuse is NOT in the best interest of the children and is virtually unheard of in Family Court.

Glad to see that many people are starting to see this case for what it really is. The reality is this could be any of us that this is happening to and I to would fight for my baby until death. These children deserve the right to have both parents in their lives you take away one parent you place a void in their lives and in this case it is avoidable. I just don’t get what the big deal is. Am I missing something here? From what I understand he wants sole custody of the kids, but they will still spend the same amount of time as they currently do with their mother. Is that not right?
